Welcome to Ajax Moving Labor (“Ajax,” “we,” “us,” “our”). These Terms of Service (“Terms”) govern your use of ajaxmovinglabor.com (the “Site”) and our moving-labor and related services (the “Services”). By booking, paying a deposit, or using our Site/Services, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Site or Services.


1) Who We Are; What We Do (Labor-Only)

Ajax provides moving labor and related services such as loading/unloading, packing, on-site moving help, furniture assembly, and specialty item handling. We are not a household goods motor carrier or broker and do not transport goods. When we load your truck, trailer, or container, you (or your carrier) are responsible for transport and in-transit risk.


2) Quotes, Booking, Deposits, Cancellations

  • Quotes/Estimates. Quotes are good-faith estimates based on the information you provide and are not guaranteed. Actual time/charges may vary.
  • Deposit. A deposit is required to secure your booking (applied to your final invoice). Deposits are non-refundable, including for cancellations, unless prohibited by law.
  • Minimums & Rates. Hourly minimums, travel time, trip fees, and rates are disclosed at booking and apply to all jobs, including wait time caused by access/parking issues.
  • Cancellations/Rescheduling. Please give 24 hours’ notice to reschedule; we’ll do our best to accommodate. Same-day cancellations or no-shows may incur a fee up to the greater of the hourly minimum or $200, plus any incurred costs.
  • Service Windows. Arrival times are service windows, not guarantees. Weather, traffic, and prior jobs can affect timing.

3) Customer Responsibilities (Please Read)

To keep your job smooth and safe, you agree to:

  • Provide accurate job details (inventory, stairs, long carries, elevators, parking restrictions, distances, specialty items, etc.).
  • Ensure safe, clear access (driveway, pathways, stairs) and secure parking/permits.
  • Box and protect items you packed yourself; close and seal all boxes.
  • Remove fragile or high-value items you prefer to transport personally (jewelry, cash, collectibles, documents, medications, electronics, etc.).
  • Supervise pets/children away from the work area.
  • Declare specialty items in advance (see §5).

If site conditions are unsafe or materially different than described, we may pause, adjust the quote, or cancel the job in our reasonable discretion.


4) Blankets, Padding & Load Security (Labor-Only Jobs)

  • Bring blankets/pads/straps. If you do not provide adequate padding/straps and decline to purchase ours, you agree we are not responsible for damage caused by insufficient protection.
  • When we do not drive or transport, we will load and secure to the best of our ability, but we are not responsible for damage occurring in transit (see §8).
  • For certain packages (e.g., Full-Service Packing & Loading), our materials may be included and, if specified, blankets you purchase are yours to keep (not rentals).

5) Specialty Items (Gun Safes, Pianos, Appliances, Etc.)

  • Gun safes: Must be empty of firearms/ammunition; declare weight and dimensions truthfully. Weight limits and stair/floor restrictions apply. We require a clear path, adequate landing space, and may decline service if conditions are unsafe.
  • Pianos/large appliances: May require additional crew, equipment, and fees; stairs and tight turns may limit feasibility.
  • Particle board/ready-to-assemble furniture: Particularly prone to joint failure; moved at owner’s risk.
  • Appliance hookups, dis/reconnection: Water, gas, and electrical connections are the customer’s responsibility unless expressly agreed in writing.

6) Assemblies & In-Home Moves

We assemble according to manufacturer instructions when available. Missing hardware, pre-existing damage, and sub-floor/anchoring constraints may limit outcomes. We are not responsible for manufacturer defects or hidden conditions.


7) Payment; Overages; Chargebacks

  • Payment due at completion (unless we agree otherwise). We accept the payment methods listed at booking.
  • Time runs until tools are loaded and walkthrough is complete. Additional time/materials are billed at posted rates.
  • You authorize us to charge the card on file for authorized work performed, materials, trip fees, and past-due balances.
  • Chargebacks. Filing a chargeback for valid, delivered services violates these Terms. We may pursue collection and reasonable costs/fees as permitted by law.

8) Damages, Claims & Limits

We treat your property with care. Still, moving/handling items carries inherent risk.

  • Labor-Only In-Transit Disclaimer. When we do not transport your goods, we are not responsible for damage that occurs while the vehicle/container is in motion.
  • Packing by Owner. Boxes and items packed by the owner are moved at owner’s risk.
  • Notice of Claim. Report any on-site damage before the crew leaves or in writing within 48 hours with photos and a description. We may request inspection.
  • Exclusions. We are not liable for normal wear/tear; concealed, pre-existing, or internal mechanical/electronic failures; pressboard/particle-board failures; cosmetic wall/paint scuffs common to moving; masonry/plaster cracks; outdoor surfaces; or unprotected items where adequate padding/straps were declined.
  • Limit of Liability. To the maximum extent permitted by law, our liability is limited to the lesser of (a) $0.60 per pound per item, (b) the amount you paid for the affected service, or (c) actual repair cost. We are not an insurer and do not provide valuation coverage. No consequential, incidental, special, or punitive damages.

9) Weather, Delays & Force Majeure

We may pause, reschedule, or cancel if conditions are unsafe (ice, flooding, extreme heat/cold, storms, etc.). We are not liable for delays caused by events beyond our reasonable control.


10) Prohibited/Dangerous Items

We do not handle hazardous materials, illegal items, live animals, open liquids, or items that in our judgment pose undue risk. Firearms/ammo must be disclosed and transported by you in compliance with law.


11) Photos, Reviews & Communications

We may document work (e.g., item condition, truck load) for quality and claims handling. With your consent, we may use non-sensitive photos/testimonials for marketing. You can withdraw marketing consent at any time.


12) SMS/Text Messaging Terms (A2P 10DLC)

By providing your mobile number and consenting (e.g., via your GHL form disclosure), you may receive texts from Ajax for service updates and, if you opt in, occasional marketing.

  • Program: Ajax Moving Labor Alerts
  • Message Frequency: Varies by interaction; marketing frequency kept reasonable.
  • Costs: Msg & data rates may apply.
  • STOP/Opt-out: Text STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to end. One final message will confirm opt-out.
  • HELP: Text HELP for help or contact 817-975-7083 / ajaxmovingservices@gmail.com.
  • No Sale of SMS Data: We do not sell or share your SMS consent data, phone number, or opt-out status for third-party marketing.
  • Consent Not a Condition of Purchase.
  • Carrier Disclaimer: Wireless carriers are not liable for delayed or undelivered messages.

Your exact form disclosure states:

13) Third-Party Services & Links

We may use third-party platforms (e.g., CRM, messaging, payments, analytics). Their terms/privacy govern your use of those services. We are not responsible for third-party sites.


14) Disclaimers; No Warranties

Except as expressly stated, the Site and Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.


15) Limitation of Liability

To the fullest extent permitted by law, Ajax and our owners, employees, and contractors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, even if advised of the possibility. Our total liability related to the Services will not exceed the amount you paid us for the applicable job.

Some states do not allow certain limitations; those limitations apply to the maximum permitted.


16) Indemnification

You agree to indemnify and hold Ajax harmless from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of: (a) your breach of these Terms; (b) property conditions not caused by us; (c) your failure to provide safe access; or (d) items prohibited or undisclosed.


17) Dispute Resolution; Arbitration; Class Action Waiver

  • Informal Resolution. Contact us first at ajaxmovingservices@gmail.com; we’ll try to resolve promptly.
  • Binding Arbitration. Except for small-claims matters, any dispute arising from these Terms or Services will be resolved by binding arbitration in Tarrant County, Texas, administered by the AAA under its Consumer Rules.
  • Class Action Waiver. Disputes must be brought individually; no class or representative actions.
  • Injunctive Relief. A court may enter judgment on the arbitration award and grant provisional relief to preserve the status quo.

You may opt-out of arbitration within 30 days of your first booking by emailing ajaxmovingservices@gmail.com with the subject “Arbitration Opt-Out” and your name, phone number, and service date.


18) Governing Law; Venue

Texas law governs these Terms, without regard to conflicts rules. Venue for any permitted court action is state or federal courts in Tarrant County, Texas.


19) Changes to Terms

We may update these Terms occasionally. The “Last Updated” date reflects the latest changes. Material changes will be posted on this page and, where appropriate, we’ll provide additional notice.
